By retaining the services of Blooming Brands LLC, you (the "Client") agree to the following Terms of Service. These terms may be updated at any time with or without prior notice. It is your responsibility to review them periodically. If you do not agree to these terms, you have the option not to proceed with our services.

1. Definitions

Services: Web design, development, hosting, and related services provided by Blooming Brands LLC.
Project: The specific scope of work agreed upon by Blooming Brands LLC and the Client.
Revisions: Adjustments or modifications requested by the Client after initial project delivery, as outlined in the package details.
Intellectual Property: Ownership of designs, code, and content created by Blooming Brands LLC as part of the project.

2. Services and Add-ons

Our services include custom web design, hosting, domain registration, SEO, and additional features as detailed in our pricing packages. Hosting and domain registration are essential for our services to function. We use NodesUnlimited LLC for next-generation web hosting.

3. Revision Process

Clients are entitled to the number of revisions specified in their selected package. Revision requests must be submitted in writing within the post-launch support period. Turnaround times for revisions will be communicated upon request submission.

4. Pricing and Management Fees

Our pricing structure includes a base project cost with optional add-ons for hosting, domain registration, and email configuration. A management fee of 30% is applied to hosting and domain services for their administration and support. Pricing is detailed in your package agreement.

5. Confidentiality

Blooming Brands LLC agrees to maintain the confidentiality of all proprietary information shared by the Client for the purpose of delivering services. Similarly, the Client agrees not to disclose proprietary methods or materials provided by Blooming Brands LLC.

6. Warranties and Disclaimers

Blooming Brands LLC does not guarantee specific outcomes or results from standard services. Hosting and domain services provided through NodesUnlimited LLC are subject to their terms, and Blooming Brands LLC is not liable for hosting-related issues.

7. Dispute Resolution

Any disputes, claims, or controversies arising from or relating to these Terms of Service or the service agreement shall be resolved exclusively through binding arbitration. Arbitration will be conducted in accordance with the rules of the American Arbitration Association (AAA).

Clients waive their rights to bring claims or lawsuits against Blooming Brands LLC in court, including the right to a jury trial.
Arbitration decisions are final and binding on both parties.
Each party will bear its own arbitration costs unless otherwise awarded by the arbitrator.

By proceeding with our services, you acknowledge and accept this arbitration clause. If you do not agree, you may opt not to retain our services.

8. No Class Actions

Disputes will be resolved on an individual basis. Clients waive the right to participate in class actions, collective arbitrations, or other representative actions.

9. Agreement to Terms
